  • Property Wanted information — property requirements, preferences, location, budget, and contact details when you post a Property Wanted listing
  • Communications — messages, emails, and other communications you send to us or through the Platform
  • Subscription information — billing details processed through our third-party payment processor when you subscribe to a paid plan

2.2 Information Collected Automatically

When you use the Platform, we automatically collect certain technical information, including:

  • Log data — IP address, browser type and version, pages visited, time and date of visits, time spent on pages, and referring URLs
  • Device information — device type, operating system, and unique device identifiers
  • Cookie data — we use cookies and similar tracking technologies to collect information about your use of the Platform, as described in Section 5 below
  • Analytics data — usage patterns, search queries, listing views, and interaction data collected through Google Analytics

2.3 Information from Third Parties

We may receive information about you from third-party sources, including:

  • NY State MLS — we receive residential listing data, including agent names, contact information, and property details, from NY State MLS through our data partnership agreement
  • Google Analytics — we receive aggregated analytics data about how users interact with the Platform

3. How We Use Your Information

We use the information we collect for the following purposes:

3.1 To Operate and Improve the Platform

  • Create and manage your account
  • Display and manage property listings
  • Connect buyers and tenants with listing agents and landlords
  • Deliver lead inquiries to listing agents and landlords
  • Process and manage Property Wanted listings
  • Analyze usage patterns to improve the Platform’s features and functionality
  • Diagnose and fix technical issues

3.2 To Communicate with You

  • Send account-related notifications and confirmations
  • Deliver lead inquiries and Property Wanted matches
  • Respond to your questions and support requests
  • Send marketing communications about LavaZoo’s services, features, and promotions — you may opt out at any time
  • Send listing alerts and market updates if you have subscribed to such communications

3.3 To Ensure Safety and Compliance

  • Verify the identity and credentials of agents and landlords
  • Detect, investigate, and prevent fraudulent activity, abuse, and violations of our Terms and Conditions
  • Comply with applicable laws, regulations, and legal obligations
  • Enforce our Terms and Conditions and other policies

3.4 To Process Payments

When you subscribe to a paid plan, payment processing is handled by our third-party payment processor. We do not store your full payment card information on our servers. We receive confirmation of payment and subscription status from our payment processor.

4. How We Share Your Information

We do not sell your personal information to third parties. We share your information only in the following circumstances:

4.1 With Other Users

The following information is shared with other users of the Platform as part of its core function:

  • Agent and landlord contact information — name, phone number, email address, and brokerage name displayed on listings you post
  • Buyer and tenant inquiry information — name, email address, phone number, and message content submitted through the lead capture form, which is shared exclusively with the listing agent or landlord for that specific property. LavaZoo does not share inquiry information with any agent other than the listing agent for that property.
  • Property Wanted listings — your stated property requirements and contact information are accessible to LavaZoo member agents and landlords for the purpose of matching you with available properties

4.2 With Service Providers

We share information with third-party service providers who help us operate the Platform, including:

  • Google LLC — for analytics services through Google Analytics
  • Email service providers — for transactional and marketing email delivery
  • Cloud hosting providers — for Platform hosting and data storage
  • Payment processors — for subscription payment processing

These service providers are bound by contractual obligations to protect your information and may only use it for the purposes for which it was disclosed.

4.3 With NY State MLS

Agent contact information and listing data received from NY State MLS is displayed on the Platform in accordance with our data partnership agreement. Agents whose listings appear on LavaZoo through the MLS feed may have their name and contact information displayed publicly on the Platform.

4.4 For Legal Reasons

We may disclose your information if we believe disclosure is necessary to:

  • Comply with a legal obligation, court order, or government request
  • Protect the rights, property, or safety of LavaZoo, our users, or the public
  • Detect, investigate, or prevent fraud or security incidents
  • Enforce our Terms and Conditions

4.5 Business Transfers

If LavaZoo is involved in a merger, acquisition, sale of assets, or other business transaction, your information may be transferred as part of that transaction. We will notify you of any such transfer and any changes to this Privacy Policy.

You may request deletion of your personal information as described in Section 8 below.

7. Data Security

We implement reasonable technical and organizational measures to protect your personal information against unauthorized access, disclosure, alteration, or destruction. These measures include encryption of data in transit, access controls, and regular security assessments.

However, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security of your information. 8.4 Google Analytics Opt-Out

You may opt out of Google Analytics data collection by installing the Google Analytics Opt-Out Browser Add-on available at tools.google.com/dlpage/gaoptout.

8.5 New York Residents

New York residents have additional rights under the New York SHIELD Act and other applicable state laws. These rights include the right to be notified in the event of a data breach affecting your personal information. If you have questions about your rights as a New York resident, contact us at the information provided in Section 10.

9. Children’s Privacy

The Platform is not directed to children under the age of 18 and we do not knowingly collect personal information from children under 18. If we become aware that we have collected personal information from a child under 18, we will take steps to delete that information promptly.
